Let me explain… I left my industry job recently to transition into a new career because the long hours in kitchen management was killing me. To ease the transition I started temping at a warehouse through an application on my phone. I really liked the job and the flexibility it offered me so I ended up using it regularly and was noticed by management for my attention to detail and punctual attendance. Apparently the other average temp this warehouse was getting were usually shady, late, and unreliable, or they never showed up for their 2nd shift.
After working at this warehouse for about 2 months, I was told by my manager that I was not going to be needed regularly moving forward because business had slowed and staffing was appropriate. This manager later told me that he may need me in the future and would stay in touch through the staffing app.
The next day I realize I’m still on the schedule for the next 4 months through my staffing app. I call my boss he doesn’t need me for the day, but this means I can’t pick up shifts at any other company through this app because I’m still scheduled at my original company. At this point I take my concerns to the staffing agency help desk, they tell me that if my company keeps me on schedule, and do not need me or turn me away from a scheduled shift, I would be reimbursed for half of the income I would have earned from said shift.
Every day I call my boss to see if he needs me, he always says no…. This has been going on for 6 weeks now and I’ve been earning $72 a day 5 days a week.
Is there any risk of legal trouble with what I’m doing? Is it worth the risk?
