I took a job that advertised online that the position was full-time, 21 dollars per hour. During the interviews I was also told this. This is a position that requires a certification too so I had to spend $400 and a weekend of training to get it (through a separate company).
Since getting the job I have yet to be given a single full time week. It’s been over a month now and even looking at my schedule ahead I still don’t have full time hours. Not only that but the pay changes depending on the duties. So if you’re doing on duty you have to sign into that one, then sign out and switch to do the other. None of this was mentioned in the ad or during the interviews. The job doesn’t meet the expectations they promised and I feel duped.
This week I only got 16 hours and haven’t gotten 40 hours once yet. Every time I ask about it I get some excuse. “We hired too many people”, “Next month for sure” (April, turned out to be a lie), etc.
One of my friends suggested I talk to a lawyer. Does anyone know the legality of this? Does it sound like I have a case? Anyone been through something similar?
Edit: I should mention that even though different duties call for different wages, my manager is “pulling some strings” to give me the 21 per hour under the condition that I “don’t talk to anyone about it”. The wage isn’t what I feel scammed about, it’s the hours.
Edit 2: I should also clarify that this is in New York USA, and the job is a major upscale gym chain that charges its members $230 a month and has locations all over America. So it’s not like it’s struggling to make ends meat.
