I’m a casual employee working in NSW Australia. Today I was at work and being the first of the month it was busy and I got asked to stay on another 2 hours over my rostered slot. Instead of noting I was working over time they just changed the roster. Is that legal?

This is my first time having worked overtime. I’ve been in work for a while just never had to stay late, this job is new however hence the different demands and I’m not sure what the rules are. I’ve also lived abroad most of my life so the law is unclear to me. I was under the impression however that working overtime you get paid a ‘penalty rate’ which is your typical wages + a percent, as dictated by the government. When I mentioned to a colleague who’s been there longer than me that I was asked to stay and work overtime he quipped ‘good luck with that’, I didn’t prove further as I probably should but it made me uncertain so I asked my manager directly, ‘xyz asked me to stay on another 2 hours, how do I make sure there’s a record that I’m working overtime’ and she…

I’m as I said unsure of my rights as a casual employee so I didn’t say anything but to me it looked like she just changed my rostered hours and given my colleagues statement I doubt I will see the penalty rate pay even if I am entitled to it.

So like Can someone clarify the law for me? And what do I do in light of that?

I think if I am entitled to it as I thought I will wait to receive my pay then bring it up and if she refuses to reimburse me then I’ll refuse to work over my rostered time again, possibly even quit as the job is pretty dull and I have other work to fall back on.
