Subject: COVID pay
Hi Everyone…Governor Newsome has signed a new bill that will cover people for when they test positive for COVID. The way it works is that you have to use your sick or PTO time (depending on your employment status). If you run out of sick or PTO time, then this COVID pay will kick in.
There have been some positive cases here recently, so please let me know if you need/want to utilized this.
Thanks!
My reply:
Hello,
I was doing some reading and had additional questions regarding these new rules. Just to be sure, the bill you’re referring to is the SB 114: COVID 19 supplemental paid sick leave?
https://leginfo.legislature.ca.gov/faces/billTextClient.xhtml?bill_id=202120220SB114
I noted this subsection (about halfway through the page):
(4) An employer shall not require a covered employee to use any other paid or unpaid leave, paid time off, or vacation time provided by the employer to the covered employee before the covered employee uses COVID-19 supplemental paid sick leave or in lieu of COVID-19 supplemental paid sick leave.
Would it then be alright for me to go ahead and submit a request for time off using these allocated COVID hours instead of using my PTO? I’d be happy to include a printout of my positive COVID test result if needed.
Best regards.
