Company won’t pay minimum as per union contract

So I was offered a temporary promotion this week (possibly leading to permanent), to a position that requires a classification higher than that for the work I was already doing. Only myself and one other person have this higher classification that is required BY LAW to hold the position offered. We are a full union shop, our contract is very clear that for a temporary promotion they have to pay the minimum pay of that higher classification. So HR tells me that they won’t pay me, only a small premium added on,which is NOT in our contract. The contract also states you can’t make agreements outside of it. I showed them the contract which proved I am correct, I said I will accept if they can show me in the contract exactly where it states they can pay what is they are offering.Total silence. They refuse to abide by the contract, and want to make all these illegal side deals to cheat us. The union tells me I’m right and they have to pay me the higher classification pay.

So I refused, they are able to get by for the moment by getting the other fellow to do it, as he is already grandfathered in making the higher wage so a premium is fine for him. But he’s retiring soon, they will be in the exact same boat, and no way I will accept just a premium.

They aren’t allowed to operate without one person in this role at all times and will have to shut down, so they can either pay me the full wage, or hire an additional person at that higher wage which is VERY hard to find. It’s unbelievable the state of our society where union contracts are no longer honoured, and every opportunity is looked for to cheat the employees out of their rightful pay. On the flip side, any time hr can use wording in the contract to cheat us for anything they are so quick to use it to the letter.

In not that long a time I can retire, I’m getting my minimum time in and leaving as I’d rather collect a small pension and work part time or for myself, what’s the point of giving your life to these ungrateful corrupt companies.
