Throwaway here.
Worked as a state contracted provider administering therapy to the disabled. Our agency holds the contract with the state, they just hire providers to fill need as it comes along. Generally a case will only have one provider assigned until it is resolved or transferred. Sometimes there will be call outs and people will have to fill, or a provider feels they are not a good fit for a specific client, but this is generally how it goes.
Car started breaking down and became unsafe to drive. Live in a kind of backwards area, no good bus service to the work site. Let the employer know that I'm going to need to leave the client I had agreed to take on since I had no transportation anymore.
Lady emails me back. Never met her before. Must be someone important. says something like “Sure could damage your career if this was reported to the ethics board.” I called in and I asked about this. Lady acts like she can barely be bothered to talk to me despite basically threatening to report me for an ethics violation. Finally get through to her, she says the state is who has been reporting providers left and right recently since many providers are dropping their cases with little notice.
Okay, I agree to work with the client for two weeks but only if my agency provides transportation (Their contract with the state is for $40 million and they are paid contingent on my arrival at the site ~3x the amount of hourly that the provider makes). Of course they refuse to provide transportation (even so much as calling an uber) so I tell them I will be leaving the agency.
Checked into it later: These ethics investigations are a matter of public record and there is no provider in the state that has an open investigation or sanctions against them. I've got some pretty rough depression and anxiety (30% VA disability), and their threatening to report me to the ethics board caused me to lose sleep and basically lose function for a week, almost two weeks.
Anyone know the law well enough to know if there's any grounds for a Negligent or Intentional Infliction of Emotional Distress suit in small claims? I guess most would say it depends on the state, however I do want to keep that information to myself for now as I live in a pretty small state.
