Not sure whether to post this query here but I’m currently furious and need advice on the legal side of how Employment Dismissal occurs and what’s the standard procedure.
I currently live in Australia Victoria, and have started to work in a well-known cafe near me starting at 21-December 2021 (around that time I believe). This job was the first job I’ve ever gotten and I got it at a time when I finished high school. I believe I was a competent worker who worked a lot, learned a lot and made as few mistakes as I could (mistakes such as giving the wrong coffee or food to the wrong customer). The way we communicate with each other is through a WhatsApp group chat where the shifts for people are uploaded for the following week. I noticed 2 weeks ago that I wasn’t given any shifts for the following week without any communication. Thinking not much of it and not communicating with my franchisee(who makes the roster for everyone) I decided to use my time more effectively and used those hours to work on uni assignments and covering shift for the other job I’m work at (I started work at another restaurant around the same time). Last week Friday when the roster is posted I noticed that I wasn’t given shifts for this week either and was wanting to communicate with him about it but decided not too as I realised I was too busy with all my assignments for university. Today is my holiday and I’ve received an email an email from the IT department (an automated email) to complete an “Exit Survey” for resigning from the cafe and to essentially do this Survey so they can improve and ya di yada…..
Panicking I quickly look at the WhatsApp group chat to notice that I’ve been removed from the group without any communication what’s so ever. I decided to call the frainchasee of the cafe to talk to him about why this was the case. Having a conversation he tells me that I haven’t been doing my online training and as a result he feels that I am not fit to work (in his possibly the worst English language I’ve ever heard, he’s Indian, so am I.). I’ve communicated with him that no warnings or messages were given to me that If I don’t complete the training I will be fired. Accepting my mistakes and after my conversation with him explaining about my situation starting uni and doing another job and essentially forgetting to do my training, he told me that he’ll add me to the group chat and activate my account to complete my training and will give me shifts for next week.
Conversing with my dad who had essentially told me what the franchisee of the cafe has done is basically illegal and me getting angry for them essentially firing me without any communication, I was wondering what I could do if he essentially continues to keep me dismissed from the job.
And also whether if I would get in trouble if he gives me shifts for next week and I don’t show to work as a way to showing him the middle finger.
