Father hasn’t been getting paid on time

So basically my dad works for a construction company and his boss never pays him on time, basically he writes out the check for the date he has to pay but doesn’t give it to my father until at least 4-5 days after he should be paying him. Recently they switched over to direct deposit and he’s been getting paid on time, but then it happened again and he hasn’t received his most recent check yet. Is this something employers can legally do? And is writing out a check for a specific date and not giving it to the employee til later still count as withholding wages? Since there’s not really any solid proof that he didn’t give him the checks on time, now that he has direct deposit he has more solid proof but still unsure what to do. Let me know what u guys think or have any…
