I was a part-time teller at a credit union, working about
30 hours a week. This past Tuesday I was approached by the assistant COO to see if I was interested in switching to the afternoon shift to better fit the needs of the branch. This would have to go into effect on Monday. I asked for a night to consider if that would be possible for me and my family, to which she agreed.
However she failed to mention that my position would be terminated if I could not make the change. I found that out later from my own supervisor.
The next day (Wednesday), I said that it would be impossible to work that position, and so they would have to terminate me, and my last day would be Saturday (which was my last scheduled shift before that mandatory switch on Monday).
Today (Friday), I asked my supervisor if she could go ahead and draw up the termination paperwork since I knew she wasn't going to be there on Saturday. I went into her office and she slid me a letter stating my RESIGNATION. I can only assume they did this to avoid paying unemployment.
I immediately rejected it and said “I'm not resigning, I'm being terminated”. To which she replied that by declining the new position (shift change) I was resigning. I left without signing anything.
I have saved Teams messages and emails as evidence of the termination, and I plan on filling a claim with the department of labor.
I also sent out a very transparent email about what had happened to me to the entire distro list, including the CEO and board of directors. It was not a very flattering light shown on them.
