recently I started a new foh job at a restaurant. its new, its the first restaurant of this couples own, theyre trying their best, i dont mind being here, its a filler job for me. that being said i have a question about how they account for tipped wages.
they require the serving staff to claim at least a certain percent of tips based on the cash sales for the shift. ie, they require you to claim 10% of all cash sales made and you sold $100 worth of food you would have to claim that you made at least $10 in tips. irs shit. so you could have in actually been given $50 in gratuity or on the other side $5.
i was always under the impression that it is illegal to directly instruct someone how to tip – i understand it is also illegal to mis-claim tipped wages to the irs. so my question is what they are doing illegal? im not looking for legal advice more than i am looking for advice on rather i should tell them to look for legal advice? bc yo, its not too common that the system works out in favor of the workers and id like my dollars and cents.
