How can I give my company a taste of their own medicine?

Hello all, I would like to hear peoples opinions/suggestions in regards to my situation. I was hired by a military company in Ontario, Canada as a Mechanical Designer to create/update 3D models and drawings for parts and assemblies. They told me my probation period is 3 months which completes today. During my first week, my supervisor asked me if I had FEA experience, which for those that don't know what it is basically simulates different case scenarios to see when and where parts/assemblies fail. This obviously requires a certain degree of skill and knowledge, to the point where I am the only designer out of 9 engineers that is capable of doing it correctly. I told my supervisor I had previously done this on my previous company so I have been the “to go” designer for FEA studies since then. My thinking was to “show off” my skills for the…

Hello all,

I would like to hear peoples opinions/suggestions in regards to my situation.

My thinking was to “show off” my skills for the probation period and ask for a higher salary once my probation period was done, since I am basically a FEA analyst instead of a Mechanical Designer at this point.

Last week a designer quit so the company posted a new job position available. This new job position description/duties are basically the exact same thing as I been doing since my first week but with a salary 25% more than my current so I decided to let HR and my supervisor know I was interested in this position and felt confident I could take on this “new” position (since I been doing it since my first week). This previous designer did not have FEA experience/knowledge fyi.

Today, HR tells me that the company doesn't allow “new” people to apply for new job positions since the company hasn't been able to assess someone's full skill set which is bs because I know my supervisor is happy with my performance and since I completed my 3 month probation, I would like to think I am not as “new”.

So here is my thinking…. I am going to sit down with my supervisor and ask for a review on my performance for the probation period. Once he is done talking, I am going to bring up my rejection for the new job position which most likely I will get a bs response, which is okay because I am going to reply with: since the job description I was hired for did not mention anything in regards to FEA, moving forward I would like tasks that fit the job description that I was hired for (meaning no FEA). I will be recording the conversation and have taken screenshots from conversations with him and HR in regards to my performance and job description just incase.

Now this is where it gets good lol the company has multi million dollar projects coming up for the next 1-3 months that require FEA literally as we speak so me not wanting to do FEA going on forward will sure throw a rock on their shoes/plans even if they hire someone new, since they will require training and will most likely need a few months to get up to date.

The question I have is: If I get fired for whatever bs reason they can make up, can I fight it? I was thinking of taking this to a small claim courts with all the proof I have so far, even if is just to waste their time lol luckily I am not living paycheque to paycheque and could afford to be unemployed for at least 3-5 years (worst case scenario lol).

If they let me go after me telling them I don't want to take the responsibility or workload for doing FEAs, which are not part of the job description I was hired for it would be pretty obvious they fired me because of this.

Thoughts or suggestions?
