How is it legal for insurance companies to spy on injured workers?

My gf was a cna in a nursing home, her job is very labor intensive and dangerous. She has been hit, spit on and verbally and emotionally abused by patients ( who cant help it most of the time, but still). She really enjoyed her job and is even going to school to bd a nurse, she was ecstatic just being able to have this job. Well one day she and two other coworkers had to pick up a 350 pound patient. The coworkers took his legs and waist, leaving the heavy upper body of the patient for her to lift. As they were picking him up his weight shifted and she fell and caught her hand on a railing injuring it. They eventually got him onto a bed and she looked at her wrist. It was swollen and discolored. Now she cant lift more then 15 pounds nor bent…

Now she cant lift more then 15 pounds nor bent it in certain directions due to tendon and muscle damage. Shes had surgery and is on workers comp, but recently she got a lawyer for workers comp because the health insurance company is saying shes faking it, even though she goes to physical therapy every week and has had surgery. The Lawyer warned her that they are going to send private investigators to her house to try to get evidence against her. Well today she got an email from the private investigator with photos and timestamps of her “using” her wrist, there are photos of her leaving her house, getting in my car, and even photos inside of a grocery store. They even have a photo of my backyard when we were sitting at a table just talking and drinking. For reference i live an hour away from her. This is a complete invasion of privacy. Shes has paranoia from previous mental health issues, and this had made them the worst I’ve ever seen. Im trying to help as much as i can, black out curtains, looking for cars parked with people in them, people walking outside, people following use in public spaces, when we go to my house i park in the backyard so the door is only a few feet away from us and we can enter and exit quickly to minimize the time out in the open. We dont go for walks anymore, we are both scared to even go outside. We now spend as much time inside as possible , all of the shades closed, doors locked , and looking at security cameras to see if we are being watched.
This is insanity. A multi million dollar insurance company is to frugal to pay less then two thousand a month that they feel the need to spy on someone so much that they have to wait for someone to make a mistake for something that she isn’t faking. She has had surgery, that should be more then enough proof. But i guess not. We are now talking to her lawyer to see our options.
We are both anti work after this incident.

Sorry if i was choppy with my story telling or left info out i am very annoyed and angry that an insurance company is able to do this, and morally think its ok. I truly hope for this to all go well and we can finally move on from this.
