So to start off I've worked in the service industry for over 10 years, I've worked at celebrity chef restaurants, Forbes 5 star resorts and basically have a lot of experience.
I got hired as a Server at a restaurant in the new town I moved to. After a few days of training they said because they were super busy they were going to use me as a server assistant for a month or so because they were really busy and “didn't want to throw me to the wolves”
I would have turned it down, but I asked the pay difference and I was told that it's no difference and I would be paid the same as a server regardless of what tasks I'm performing. So I said okay, as long as I'm making the same that's fine.
Well, yesterday after 2 weeks working there they told me that actually I DON'T make the same as servers and I'm actually making 33.3% less than I was told.
I wouldn't have accepted the job (I had other interviews) had I known that, but now they're saying that they are going to give me serving shifts in a month or so.
They even told me I had to sign new paperwork so that I can get paid less.
I feel like this should be illegal as I only accepted the job because I was told I'd be paid as a server, but I'm also in a “right to work” state which means that they can fire me without cause.
So I don't really want to start trouble and lose a job (train for 2 weeks at a new place before I make any tips at all), but I also feel lied to and don't know if I should sign the new paperwork and hope they're true to their word about moving me to server.. or go try to find something new.
