Hi everyone, I need some clarification about if my restaurants current tip policy is legal (NY if that matters) The past two summers my bosses have been hiring workers through SYEP (Summer youth employment program) who are paid around 1000 a week by the program for around 8 weeks. The regular servers like me are paid 13 an hour plus tips to make up the difference for the minimum wage. My tips vary nightly and can be between 30 and 100 dollars. Since the syep servers are paid by the program, they don’t receive any tips. My boss has been splitting our tips on nights where we are working with one other syep server and spending the other half on supplies and repairs for the store. Are we entitled to the entire tip for the night or can my boss take half? any help is appreciated, thank you!
