I have been a CDL Class A driver for 7yrs now. 4yrs OTR and now 3 yrs Local.
I have a situation that I am not sure if it's actually legal per DOT/Labor laws and can't figure out how to combat or if there is even anything to combat.
I am a hourly paid local driver
I run a run from 1:30am-11:25am (9hrs 55mins)
A “Off duty” sit at terminal wait for 2hrs 55mins in the middle of the run with no pay
We run E-Logs
I start at our local yard pick up a load and travel to point B (2hrs away) where a delivery & pick up is as well as our main eastern terminal.
After delivering they want me to go to that main terminal and sit for 3hrs. Originally with no pay, but after arguing they now will pay 1/2 of that time but I must remain off duty at that yard. I am not local to that area so it's not as if I can just leave and go about as I could if I were at my starting destination. So from 4:50am-7:45 am I am to sit there off duty with only partial pay.
Sometimes the delivery and pick up runs into this “layover” time but they are saying I can not be paid for it due to them already paying partial of a layover pay even though this extra time worked I am “on duty” or “driving” not off duty…
Literally my check is 11.83hrs short for time that I am “on duty” or “driving” but since I should be at the yard “off duty” and they pay for partial of it I will not be paid for those 11+hrs
Sorry for rambling, hope this makes sense. I don't know if this is even something to combat or not. Not so much info regarding this especially since I now only travel within 150miles round so I don't technically have to use logs. Mostly all info surrounds OTR.
Any info/ideas etc would be greatly appreciated
