Kitchen Heat Help

Hey gang, Long time lurker, first time poster. I work in a corporate kitchen, our a/c went out end of last summer (August). A/c company said the whole unit needed replaced. We also have a few employees quit, just too darn hot to be cooking in. Our GM got us portable a/c units last year but it was still almost 90 degrees in the kitchen, the rest of the building is 70 degrees. It was almost 90 degrees in the kitchen yesterday and likely to be as hot the rest of the week. They've still not replaced the A/C Unit. Is this an Osha violation? Or some other agency that can force them to repair the A/c?
