I work at a restaurant that’s had bad business lately, so much so, business is often at a stand still. There will literally be hours of no customers, but the store remains open, and two employees have to stay there at all times. I should note all of the staff works long hours (usually any where between 8-12). My manager recently put up a sign stating it’s okay if we want sit down (how generous ), but we have to clock out for an unpaid break and can clock back in when we stand up. Obviously we don’t sit when there are things to be done, but the other night, we had five customers within four hours. The place was scrubbed top to bottom. Prep was done. There was literally nothing else to do. My manager understands that sometimes there’s nothing to do, and we can stand there doing nothing, but we aren’t allowed to sit doing nothing?? I’m completely ignoring this rule because f*** her, but is this even legal??? She’s pretty much making us stay at work while clocked out because business is bad.
