So I work as a restaurant server for a corporation in the United States. We have different shifts for different parts of the day including a “breaker” that comes in at 2pm to ensure the night staff is able to take a 30 minute break. The “breaker” will watch all your tables and take orders of new tables that come into your section. You keep the tips of the tables in your section, but you pay the breaker 10$ for watching your tables. I'm fine with that concept, but more often than not, they break you on a slow period and you don't receive tables or tips in that 30 minute duration. Management says that no matter what we have to pay 10$ to another employee even if they aren't looking after our tables as it's “part of their pay”. My question is what is the legality of me having to pay someone money to go on my break while they stand around and do nothing.
