Oklahoma, US. We have absolutely no money for the surgery. None. We go without already, eating only ramen or a few bites each day. My rabbit had to go to the vet yesterday, it cost our last $340. Long story short they did nothing except say I’m right his teeth are bad & prescribe meds to get him through a whole week of waiting for surgery. Pre-surgery bloodwork as well ($170). He needs to be hand fed soft foods, has tooth pain so hardly eats, and I’m exhausted.
My bf worked as an independent contractor except a contract was never signed. They hired him verbally, he worked for them for a year, they wrote his checks as a 1099. After a while of my bf doing his best (too much, they took advantage) they started telling him when he had to be at jobs and getting pissy with him when he didn’t keep their schedule. Eventually he had enough and didn’t sacrifice his comfort one Monday morning to show up to a site 2 hours away at the time they said to be there. He did not agree to the time, since it was his coworker who told him when to be there (bf was doing the job alone tho, coworker just told him a time) and was sick of all the crap they’ve pulled in general so tbh wasn’t happy working anymore.
Well he got fired for being late after driving to the site. Boss didn’t even call at the time he was supposed to show up to see why he’s late, let him drive the whooleeee way, over 2 hours. However, his boss did not pay him for his last week of work the week before that. He will not put in writing that my bf got fired either. So my bf was screwed out of a week of pay (~$1000) and may not to be able to claim unemployment if they claim he quit (they would have to claim he quit by job abandonment tho and we don’t think that’s possible for him to have done since he’s 1099, boss never told him a time, and he didn’t have a contract).
He called the labor board and they said there’s nothing they can do. In fact, all they cared about was that his boss had employees working without licenses (he claims they can work under his license)… basically they only cared about the fines they can issue for themselves. It’s a massive gut punch.
So… Labor board is saying they can’t enforce him getting paid for the work he did that last week. Where do we file a claim now?? A civil suit? Do we need a lawyer for that?
Also to get the confirmation we need… we have the boss’ number and the office location. We need to get in writing or recording that my bf was not given his final check (and it would be nice to have admission of him being fired if he ends up needing unemployment). We can record the conversation, and either of us can use our phones to attempt to get him to answer our call (he will prob ignore bf’s phone). Would it be bad to go to the office where the telemarketers are to record a confrontation if phone calls fail? Would he have to stay outside or could he go in (door stays unlocked but it’s not a place where customers go inside.. there’s a no soliciting sign but i don’t think that matters)? Any suggestions on what to say to get an admission out of the boss that he was never paid?
