Like the title says I'm looking for resource material that pertains to labor laws as they affect flat rate automotive mechanics…. Particularly being forced to watch mandatory training videos during work hours and not being paid for it. Also, is there a limit as to how long you can be forced to wait for work while not being paid? For example, If someone gets to work at 7am and there is no work for them to do is there a limit as to how long they can be forced to sit around for free and wait for work?
I'm looking for people with knowledge that relates specifically to this situation. I know a lot of people are going to want to say “anything mandatory has to be paid” and so forth. However, there are a ton of loopholes built into how flat rate mechanics are paid making them exempt from many of the FLSA standards including overtime because employers classify them as commission based.
The government sites for DOL, FLSA, etc. are very vague and contradictory on the topics relating to this situation. So if anyone has any incite, particularly links and verifiable material, as to exactly what flat rate auto mechanics who's pay is classified as commission can and can't be forced to do it would be greatly appreciated.
