My apologies if this is not the right place to post this –
My current workplace is mandating that we are to return to working in person on a hybrid schedule (2-days) a week. However, per CDC guidelines the COVID community level is rated “High” and should require us to have screening policies/masks. They have not formally communicated what the policies around returning to work will be like – my manager has just given our team a heads up that it is coming. I told my manager that I will be pursuing an ADA request (due to ongoing mental health issues that will be exacerbated by returning to the office)
On one of the forms for my accommodation through ADA – my manager has stated that my continuing to work from home (which I've successfully done for over 2 years now) will cause the business “undue hardness”.
My questions are: if I file the ADA accommodation request to continue to work from home – Am I able to come in if it's an emergency and for short periods of time – not routinely and not the full day? Or would that invalidate my accommodation in any way?
Why would continuing to work from home (again, after I've successfully done it for more than 2 years) create undue hardness for the business? Especially – I should note that half of my team is in a different state.
What are my options? I am based in AZ, USA.
