UPDATE: I’m getting fired tomorrow because I won’t sign away my rights

Hey folks, ​ As promised I would bring the People news of what has occurred here. tl;dr: I'm not actually fired yet, they are currently now “considering all options” which sounds like code to make sure they have covered their asses before I'm formally terminated. First, I want to clarify several misconceptions people have had. If we're gonna properly fucking change Labor in the United States of America, we have to get this shit right. This is absolutely legal. I'm in an At-Will Employment State, which means they can fire me for giving them a dirty look. Terminating me for declining to sign the agreement isn't illegal, it's just trashy and bad management and showcases to all the other employees that they are worth less than something as transient as policy. It destroys Office Culture and morale, and I would not be surprised to see other incredibly valuable team members…

tl;dr: I'm not actually fired yet, they are currently now “considering all options” which sounds like code to make sure they have covered their asses before I'm formally terminated.

First, I want to clarify several misconceptions people have had. If we're gonna properly fucking change Labor in the United States of America, we have to get this shit right.

This is absolutely legal.

I'm in an At-Will Employment State, which means they can fire me for giving them a dirty look. Terminating me for declining to sign the agreement isn't illegal, it's just trashy and bad management and showcases to all the other employees that they are worth less than something as transient as policy. It destroys Office Culture and morale, and I would not be surprised to see other incredibly valuable team members depart because of it. In the end, failure or success of a business comes down to management. A company is literally just a community of folks doing jobs, and casting out one of us for daring to say no we have these rights and we're not giving them up directly harms that community.

But what we have seen too often in America is that what is right and what is legal are two completely separate things, and these days all too often on opposite sides.

As many posters have pointed out on the other post, Arbitration Agreements are increasingly being used by employers. It saves costs on their bottom line. That doesn't mean they should be accepted as the norm.

I wanted to share how I joined the People in saying fucking enough here.

I sent a rather blunt, and admittedly a bit confrontational and cheeky upon honest retrospection, email this morning to my boss laying out that he needs to let me know when he wants me to leave. I spoke with him this afternoon and he laid out I can keep working while he “considers all options”, but it sounds like they're making sure their asses are covered. I let him know I would continue to do the same outstanding job I had been doing, because I was there for the sales agents.

I was scheduled and approved to work from home Tomorrow and Friday, but told HR flat out I would no longer be using their Spyware monitoring software and was summarily informed I could no longer work from home so I think I'm going to ignore my phone and apply to places instead.

Here's the thing: I'm a vital resource for our entire department, providing much of the flow of information about what's happening in the field and keeping the revenue flowing by keeping my boys and girls equipped and supported to do their job selling green energy as a supplier door to door, which is a hard as fuck job. These motherfuckers brave ice and snow to ask “hey can you give a fuck about the planet?” Without them the whole engine comes to a halt, so they really need to be supported and equipped, but more than that, they need to be protected from whack ass awful sketchy workplace shit. They shouldn't worry about gross negligence or fucking wage theft. They should worry about doing sales because that's hard enough as it is. For them to be forced into this one-sided closeted arbitration bullshit, it allows the company to hide patterns of improper behavior that would be invaluable to future cases. Arbitration isn't 100% one-sided, but there's clear evidence that the bias exists towards employers which is why democrats are carving out the most heinous offenses already.
