Why are employers allowed to not employ you for being overqualified?

I understand their reasoning. You're too ambitious and likely not going to stick to the job for very long, seeing it as a stepping stone to what you want. But isn't this discriminatory? It reads like “You have too many options and it intimidates us that we can't keep you under our thumb.”
