Alright, so I just recently started looking into some potential sketchy shit about my job. I really need some educated advice on if this shit is legal or not, as I'm not entirely familiar with the laws.
Let's just say I work in Illinois at one of the biggest fast food chains in America.
My coworker agreed to come in on her day off, and then found out she wouldn't be getting OT pay even though she's over 40HRS for the week. Apparently they only do OT pay if it's over 80hrs in the two week pay period? I'm not entirely sure, but that sounds incredibly illegal. I believe she called them back (at LEAST 4hrs in advance from the shift she said she would take) and told the manager that she wouldn't be picking up that shift, and now she's getting written up for it.
Another thing I'm unsure about is their break policy. We're only allowed one 20 minute(paid)break if we work at least a 5 and a half hour shift. ( So if we're scheduled for 5 hours, we get no break.) That one break is all we're allowed in up to a 9hr shift. I'm not sure if this is legal either, but as I said, I know nothing about the law or if they're above something that I'm unaware of. Any help would be greatly appreciated
