I was never able to get a clear answer on this. Note that I was an hourly employee and not a contractor.
I worked for a company in Illinois, USA as a massage therapist. I was paid $35 for each hourlong session with a patient. However, it was often a requirement to go off-site, say to a gym or function, to do “promotional” therapy. During these times, I was only paid $20 an hour. Any work performed that was not therapy, i.e. SOAP notes, e-mail correspondence, meetings, etc. was unpaid. I also had to undergo three months of unpaid training to learn the practice’s “proprietary” treatment technique. I didn’t last long and went back to being a contractor.
Was this legal?
