My partner lost their GM today and is being expected to take work calls from home- as an hourly employee.

They're the assistant manager and the general manager position is currently vacant. My partner is an hourly employee who clocks in and clocks out like any other associate but has been getting bombarded with work calls and requests for scheduling at home since the change in leadership. District manager hasn't communicated any intent to upgrade their position to salaried or appoint a new GM. This can't be legal, right? It stinks of wage theft. State is Virginia, sector is retail.
