“All tips are donations to nonprofits” at coffee shop in MA

I just accidentally tipped thinking that my tip was going to the server when it in fact was going to a nonprofit. Which I assume the business gets a write off for. If I had known I wouldn't have tipped. Is this illegal in Massachusetts?
