I think I might have a law suit here… seems illegal.

I'll start with some basic info: I work in IT, I took a job I was over qualified for due to the hiring manager saying I was going to be his assistant and get paid more because of it. The first year everything was fine. There was a lady that worked on the team and was not very tech savvy, it took her forever to do basic tasks because she only knew how to do things manually. She instantly felt threatened when I was hired. I was automating these simple tasks so we could focus on bigger problems. She would constantly complain to the director about me etc… Around 4 months ago, the company “restructured” a new director was brought in and she knew him. She immediately talked her way in to becoming our new manager. Ever since then she has been foaming at the mouth to get me fired.…

Around 4 months ago, the company “restructured” a new director was brought in and she knew him. She immediately talked her way in to becoming our new manager. Ever since then she has been foaming at the mouth to get me fired. She forced everyone to do things manually so she didn't feel dumb anymore.

Well around a month after she became manager I had a MAJOR health issue. I went to the hospital and was told I have congestive heart failure. I stayed in the hospital 2 weeks, then my doctor recommend I take it easy and get FMLA for 2 months. So I got the paper and while waiting for him to fill it out and fax in my new manager starts in about if I don't have the paper work, I need to work.. so I worked 1 day… (I let her know I was functioning on 85% oxygen and about 35% heart function and wasn't mentally sharp)

I get a call the next day and the director gives me a verbal warning. I finally got the FMLA paperwork turned in and they received it. I get a call from manager about a week later saying I had to the next day because my doctor didn't write a clear return to work date on my paperwork. So I said Ok I'll get it corrected in the morning. Well there was a snow storm and the doctor was not in. So I work 1 more day, I immediately get a call at the end of day saying I'm being written up for a mistake I made. I finally got a doctor's note with a statement saying “please excuse (me) for the past month and 2 months in the future”

Well now it's time for me to go back and I'm POSITIVE she will get my fired this week. I sent emails to the director before she was promoted saying I think she is actively targeting me. I sent letters after she was manager too with no response.

My question is, if the doctor covered me for those 2 times I worked while on FMLA, can she or the company get sued for writing me up knowing my situation and me explaining it multiple times? I mean she was giggling when she threatened my job if I didn't come back to work before the official letter, she can not wait to get me fired ASAP.

P.s. part of the restructuring was new shifts which went from m-f 8-5 to 24/7 and put me on a graveyard shift, which I did not agree to in the interview or when they did it.
