How in the heck is it legal that the US government has non discriminatory hiring laws for people with disabilities but still not hire candidates if they fail a drug test because they are prescribed a medication?

Pardon my French, but seriously how has no one challenged this in court? You can't discriminate towards someone diagnosed with Parkinson's or depression but you can if they are treating it with a prescribed medication? Where my comrade legal experts at?
