Interviewed for a banquet server position, it’s below minimum wage because gratuity is “commission”

In some states servers legally get paid below minimum wage because tips make up the rest. I don’t live in one of those states, here in Oregon servers must be paid full minimum wage. Unless they’re banquet servers at a fancy hotel apparently. I just interviewed there, and needless to say I won’t be working there, but is this somehow actually legal or should I contact the dept of labor?
