I work for a third party company that remodels big chain stores. Two nights ago was my unexpected last shift on my current project. I was working two hours overtime (which I will no longer be getting paid overtime wages for because they did not allow me to finish out my forty hour work week), and I started to experience an anxiety attack.
I am diagnosed with severe anxiety which I do take medication for. I was not able to take my medication on time because I was not able to leave work until three hours past the end of my shift. I travel for work and am not given a car, so after the attack I had to wait outside for an hour until the rest of the team was allowed to leave.
When I felt it start to happen, I went to the bathroom in the back of the store to get in a stall and call my mom since she is the only person who is able to help talk me through them. I was trying to be as quiet as I could, but I did not realize that there was another person in there at first. The other person turned out to be the Project Coordinator who works for the store, not the company I work for. I verbally said out loud to my mom that I was experiencing an anxiety attack, so it is known that that’s what it was.
I’m not being fired completely from the company, but I am missing out on overtime wages and a full day of pay since they did not allow me to come back. I do not have written proof of me being told not to come back for the last day of the week; it was over a phone call.
I have email proof that my removal is over the “occurrence in the bathroom.” Is there anything I can do to get my missing wages back? I get paid $20.50 hourly, so my overtime would be $30.25. I have worked overtime at least half an hour, mostly more, everyday.
If you guys could help me, it would be greatly appreciated.
