Age Discrimination

Yesterday I had an Interview and I have to vent. Position is a field service tech servicing kiosks. My last contract ended for good and me and my fiance are expecting our first child in November. Walked into the interview knowing because he told me, that is was between me and one other person that would be hired. I met with the interviewer. I havent interviewed for years but felt it went really good and felt that I also clicked with the interviewer. He did ask me what part of the country I was originally from, which most do, being from Boston and living in CA. I thought youbwerent supposed to do thisnin an interview, but this isn't the thing that bothered me. I also mentioned we were expecting a child in November and have had some mixed reviews from people I know that told me I shouldn't have mentioned…

My last contract ended for good and me and my fiance are expecting our first child in November.
Walked into the interview knowing because he told me, that is was between me and one other person that would be hired.
I met with the interviewer. I havent interviewed for years but felt it went really good and felt that I also clicked with the interviewer. He did ask me what part of the country I was originally from, which most do, being from Boston and living in CA. I thought youbwerent supposed to do thisnin an interview, but this isn't the thing that bothered me. I also mentioned we were expecting a child in November and have had some mixed reviews from people I know that told me I shouldn't have mentioned that. So that is also got me worried.

Near the end of the interview he started bringing up how old some of his workers are and a lot of them are getting prostate cancer. He then states that he normally seeks out people 55 years old or older for the position. He then quickly goes on and mumbles something about switching that up, blah blah blah. I avoided the comments and quickly changed the topic and asked him about something company specific.
During the entire interview I felt like I absolutely nailed it, especially on every question I answered.
It was only when he brought up age and the prostate issues and liking to hire people over a certain age, that my stomach just dropped.

He told me he would not call me if I didn't get it and if I don't not hear from him by the morning of 6/3(tomorrow), I did not get the postion and he went with the other person.

Being super annoyed today and sitting in my hole in my mind because of both Not Knowing and this person bringing up age like he did in the interview, I decided to look into Age Discrimination during an interview.

I found an article that basically says, CA and Federal Law Age Discrimination only protects people that are 40 years of age or older.
I almost hit the floor when reading this.

I was 50 days shy of turning 40 yesterday.

There is also a chance this person does call me tomorrow, which would be so awesome.

I will follow up tomorrow if I do or do not get the position

Any insight if I am protected because of anything that happened during this interview would be very much appreciated.
