Background: employed in a large art warehouse space in CA. The new manager has a real tweaker vibe. He often talks at the team for literally hours about his ideas, instead of us ya know, doing work.
The situation: today while talking at a coworker for over an hour and a half, my coworker started fidgeting.
New manager: stop fidgeting and pay attention
Coworker: I have adhd, I’m listening to what you’re saying but you can’t tell me what to do with my body.
New manager: clock out you’re being insubordinate
Coworker calls boss. Boss says they have to produce a dr’s note saying they have adhd. My head is spinning trying to figure this one out. I assume the boss is attempting to go down the road that fidgeting is a reasonable accommodation for adhd? Why for the love of god is my boss trying to say that no one can fidget while anyone talks? Is this legal? Again, we’re in California where we do have a lot of worker protection, but my research for the intersection of dr’s notes, adhd, and workers rights in California is coming up short.
