Can my employer make me split my FMLA?

My wife and I are trying for a baby and I am under the assumption that because it’s family medical leave, both of us would be entitled to 12 weeks off once the baby arrives. But she said that 6 of our coworkers that have had children with each other (3 couples) had to split it up as our company’s policy is it’s 12 weeks “per baby” not “per person.” So they only got 6 weeks each, or had to split the 12 weeks between the two of them somehow (2 of the fathers didn’t get any time off and gave it to their partners instead). This is NOT maternity/paternity leave. It’s FMLA. Is this legal?
