Company manipulated my brother into resigning. I helped him get unemployment anyway.

My brother was in a high pressure sales environment in the mortgage industry. Things were great, but as rates have bumped up recently, the business has dried up. This has resulted in the company applying incredible pressure to the employees and forcing them into being extremely manipulative with customers. My brother couldn't take it, after being screamed at for weeks because he had to ask 3 times for everyone to refinance, and he had to also suggest a refinance for people with an already lower interest etc, he snapped. He couldn't eat, he couldn't sleep, he was having a nervous breakdown. I told him he needed medical accommodation, to request to either be moved into a non sales operations role, or to be exempted from high pressure sales tactics. I told him he needed medical accommodation, to request to either be moved into a non sales operations role, or to be exempted from high pressure sales tactics.

In companies I have worked for (generally ethical, compliant companies) typically what happens when you put in an accommodation request for medical reasons, you would be removed from your job, and sent home with pay for 60-90 days and the company would work with you to locate another position. More or less as long as you were qualified for the job i.e. met the minimum requirements listed in the job posting you would be given priority when filling it. For the most part unless the accommodation is weirdly specific and restrictive, this resulted in job placement fairly quickly.

I expected a roughly similar experience for my brother as he was working for a pretty large company. What ended up happening is that his manager set up a meeting with a senior manager and they told him that there is no jobs and if he can't do the job that he needs to email them a resignation. HR was not called, and nor did they make any efforts to try to help him. He being really frazzled unfortunately just accepted their word and emailed the resignation and logged out and returned his laptop.

I told him that they definitely were manipulating him into quitting to avoid paying unemployment. I told him to apply anyway and tell them he was denied medical accommodation and told he had to resign immediately. Unemployment was approved and when the company contested saying he willingly left the company, they declined the company's appeal.

So please make sure you know your legal rights, document everything and do not let the company try to manipulate you into quitting. My brother fortunately found new employment within a month or so, and the unemployment check is really just a nice bonus for him now fortunately, and a good reminder of the time he stood up for himself and won.
