Like the title says my company will not pay out my accrued PTO as I voluntarily resigned. This year i have accrued 60 hrs of PTO so far. I accepted a position at a new company and put in my 2 weeks notice. I was under the impression I would be paid out for my PTO as I have been for any other company I have every worked for. I asked my manager at the start of my shift today if there was anything else I needed to do for HR and asked i my PTO would be paid out on my last check or if it would be on a separate check. He then says that he doesn't believe they pay out PTO. I check the employee handbook and there it is, if a employee voluntarily resigns their position they will not pay out PTO and no PTO can be taken during the resignation period. The kicker to this is that if the employee was terminated then they would have to pay out the PTO unless it was for “cause”. I check our state PTO laws and they say “vested vacation” days must be paid out, but right after that says the state Supreme Court ruled that companies have no obligation to pay out PTO unless outlined in their employee handbook. So now I am just fucked out of my PTO i earned this year with no recourse. This was going to help pay for my medications for the interim period of no insurance as my new employer does not offer insurance until after 90 days. I guess the only bright side is the 2x salary at the new position.
