I've been working at this place for a total of 5 years now and up until today I've been given a schedule that works around my school schedule. I'm working part-time of 24 hours a week, however on my letter of employment it states 40h full time (I don't know why).
Recently my manager has said that they would no longer be accommodating my school schedule unless I take an extra shift. This extra shift falls on a day that I have classes and they are 100% aware, as I've handed my schedule to them when asked, on time.
In addition, I've missed some days at work because I can't afford to skip these lab dates that are scheduled or else that would result in a failing grade. As a result, I've been given a letter for absenteeism for two days missed.
They say if I can't adhere to the current schedule which is Sat – Sun – Mon – Tue, they will have me as part of the regular schedule Mon through Fri 9-5 and I will then be responsible for my schedule, and of course combined with the letter of absenteeism, would result in termination. The latter portion about termination was not mentioned but it is stated in the letter that missing further days would result in termination.
I've asked for them to provide a written letter stating that if I can't work on the added date then I would be subject to termination by effect, and they've refused. I've spoke to my manager and senior manger simultaneously in a call and both deviated from the question.
The fact is, they can modify my schedule at a whim, as I'm currently working the schedule given which was modified by them. They're basically saying if I don't work the extra day, they won't give the schedule I've had for over 4 years.
I would appreciate any advice and like to know if I have any legal options
