Got Covid on January 1st 2022 before the bill passed. Bill states any employee that took leave for Covid related issues beginning January 1st is entitled to retroactive pay. The problem is I quit because they had forced me to use my Sick and Vacation Time for the absence. At the time there was no way to know if the bill was going to pass but my employer told me if I tried to take any time off for the rest of the year it would be unexcused and I would face disciplinary action. I absolutely needed time off to fix my car and go to the doctor.
I filed a claim with the state but I'm getting mixed responses from the labor board. Some say they don't owe me anything because this bill was passed after I quit. Others say it doesn't matter I was covered at the time only because it's retroactive.
I have a conference on the 28th of this month and I'm just curious if I have a leg to stand on. They're claiming my employer did not pay me my sick and vacation time. I'm trying to explain that they technically did but it was Covid related and the bill provides the supplemental leave for covered employees who took time off during that time.
I've made an Inquiry to a Local Employment law firm but I don't know if I'm just wasting my time. Has anyone gone through this? The FAQs on the website don't seem to address this situation exactly.
