My wife works at Amazon and did the same thing other employees do, except she was fired for it and not given any kind of written or verbal warning. She was on her phone at work while sitting inside a turned off RC forklift. No warning of any kind given. She just had a meeting with sr.ops, safety, and HR, they said they would retrain her, and a few days later she received her last paycheck and an email terminating her. I understand she did break the rules and she should be disciplined for it. But I’m wondering if there is any kind of wrongful termination here. Some background for her: she is latina, and doesn’t speak perfect English. A couple of people have told me I should try suing for wrongful termination and Amazon would settle out of court. I’m curious if anything can come out of this.
