Do non-compete agreements actually get enforced?

I work at a very unique kind of business, and I want to retain anonymity so let’s just say we sell a food item that very few people have heard of, and there is a large potential market for. Long story-short. The owners of the business are weird and crazy and have kept the business running for almost ten years but they keep making these self-sabotaging decisions that blows both of the employees and regular customers minds with how absurd and ridiculous they are. We are now at a turning point where we are losing our best location because the wack-a-doos forgot to renew the lease. They will probably still operate out of their shitty shops that barely support themselves, but a number of us are considering leaving and starting our own business that sells this food— seeing as how the long term survival of the company appears indeterminate. Long story-short. The owners of the business are weird and crazy and have kept the business running for almost ten years but they keep making these self-sabotaging decisions that blows both of the employees and regular customers minds with how absurd and ridiculous they are. We are now at a turning point where we are losing our best location because the wack-a-doos forgot to renew the lease.

They will probably still operate out of their shitty shops that barely support themselves, but a number of us are considering leaving and starting our own business that sells this food— seeing as how the long term survival of the company appears indeterminate. We can take out loans and have regulars who are willing to seriously invest to get us started.

We are under a non-compete however and I’m wondering if these actually get enforced? Amazingly the owners are actually petty enough that while they don’t follow up on 90% of their duties they might actually try to sue us.
