Employer Forcing Me Back to Work Against Doctor’s Advice

(Nova Scotia, Canada) Hey there! This may end up being long winded and confusing because I'm pretty upset, but I'll try to be as coherent as possible. So, several months ago, I was involved in an incident at work (as a bystander, was caught up in an accident that happened a bit away from me) that ended up with me having a pretty severe shoulder dislocation. The bone was wedged under my clavicle (out of joint with my arm stuck above my head), my rotator cuff was ripped to bits and the only thing holding my arm onto my body was some skin. My supervisor walked away, telling me to “straighten it out.” Took half an hour for another employee to discover me and an ambulance was called. This may end up being long winded and confusing because I'm pretty upset, but I'll try to be as coherent as possible.

So, several months ago, I was involved in an incident at work (as a bystander, was caught up in an accident that happened a bit away from me) that ended up with me having a pretty severe shoulder dislocation. The bone was wedged under my clavicle (out of joint with my arm stuck above my head), my rotator cuff was ripped to bits and the only thing holding my arm onto my body was some skin. My supervisor walked away, telling me to “straighten it out.” Took half an hour for another employee to discover me and an ambulance was called.

When I asked for worker's compensation papers, I was told they didn't have any and they would contact me. I went in a couple of days after that, and they had to print them off because they still didn't have any forms, but ultimately I did fill them out…. Except they, then, refused to send the paperwork in. After fighting some more, I ended up having to call the Office of the Workers Counsellor to get them to do the paperwork for me.

Needless to say, there's A LOT of information I'm leaving out for the sake of anyone reading.

It's, now, been five months and I am JUST beginning to develop mild use of my arm. Last week, my deltoid twitched for the FIRST TIME since the accident!

Well, this entire time, both WCB and my employer want me back in this industrial worksite, against the recommendation of my physiotherapist and my doctor. Both are saying that the work they've proposed will cause a Repetitive Stress Injury and I'll be lucky to make it three days before I aggravate my shoulder and re-tear the muscles that are finally trying to knit themselves back together.

Neither parties like this answer and I've been given a “Too bad, if you don't go back, you lose your compensation.” Seeing as I only get one body to live in for the rest of my life, I told them I'd be taking the advice of the people treating me and declining their offer.

They are BOTH still going after me, non-stop. My husband is paying for my physio. I can't get another job in my current condition. Lawyers don't want ANYTHING to do with WCB. I need advice on where to go from here. I have an appeal filed, but my employer is threatening to fire me. I just don't know what to do, anymore. My employer and WCB seem to be untouchable.
