Employer promotes 6% retirement matching. Refuses to match remaining 2% for last year.

Finally doing it.. this is my last week. So terribly excited to leave this toxic work environment. Apparently my employer only matches 4% with each paycheck. Then, once a year they contribute the remaining 2% from the year as a lump sum. Since I am leaving before this occurs, they are refusing to square the IRA. Another thing that has troubled me is a “smoking surcharge,” of $40 every two weeks. Isn’t paid to insurance, but directly removed from my check for the company. Is there any recourse for enforcing the match? Is the smoking surcharge even legal?
