I work as a CNA in long-term health care. Over the blizzard in upstate New York my facility called a code 99 twice, that’s a disaster called meaning nobody can leave the building. The first time it was called I was forced to be in the building for 30 hours. After 18 hours they told me to take a four hour rest and then come back to work. Now that the weekend is over and payroll is closing tomorrow I have found out that our facility decided not to pay us for the four hour rest. We get overtime for anything after eight hours. So not only are we losing that four hours of pay but it resets our time clock, so the remaining, eight hours of my 30 is regular time instead of overtime pay. We don’t have a written policy regarding pay during a disaster code but our administrators have just made the decision to not pay us for the four hour rest. Is there anyone on this forum that can answer
To the legalities of the situation? Naomi where we forced to take a four hour restaurant we were never told it would be unpaid. We were informed that if we left the building, we would risk immediate termination. Im under the assumption, that if we are forced to be at work and we have to be paid for it. Sorry if there is any mistakes, I am driving and using my talk to text. I am happy to copy and paste some information I have found from the fair labor standards act on the Department of labor website. I’m also about to read our union contract although I don’t think it’s stage anything about disaster pay. I have an email typed out to our head administrators, but I’m scared to send it for fear of retaliation. I want to make sure my information is correct before I send anything.
