I recently quit my job on Sunday. I work in a restaurant with high turnover and at will employment. I was entitled to my final check by Wednesday by 3:30pm but when I texted my manager about it he tried to tell me they ‘couldn’t write individual checks anymore so I would have to wait for payroll on Monday’. I informed him that that would incur a daily waiting period fee of one days wages (~$188 a day) and he instantly texted and said I could pick it up between 10am and 12 pm today. I let him know that I work mornings and would not be able to meet at that time. I received no response. Today I tried to get the check when I left my new job and the manager said that the check could only be given to me by my chef (the owner) and that he was only here during those times which I know to be untrue because he was always there when I was working. When I texted the owner and threatened legal action they sent me a short story saying that only the owner or the assistant manager could disperse my check and that both need to be present to give me my check. They are giving me the option of jumping through their hoops or just mailing it to me. What should I do? Is this even legal?? The whole situation feels wrong to me. Any ideas would be great!
