I recently started working alongside a company doing inspections. I am an independent LLC working through this company. It was made explicitly clear in numerous forms I signed stating I am an IC, etc. I have only recently started with these folks, so this thread is more of a “in case I need it.” I hope I don't but it's better to be prepared.
Upon initial “hiring” (unsure if that's the correct terminology in this case) I made sure to get email confirmation that I am in charge of the days I work. I am being sent jobs to complete from a different person that confirmed that now, and I made it quite clear what I'd like my schedule to be. This individual pretty explicitly stated that there will be problems with that in the near future.
Based on my understanding of being an independent contractor or an LLC as I am, I work for myself. These people are a client of mine. If they expect to dictate my schedule I have to be a w2 employee. Is this correct? What is the best way to proceed?
I am located in Tennessee, this company is headquarted out of Georgia, with contractors all throughout the states. Any advice is helpful. It's a good gig all in all so I'd really like to work out a way to come to an agreement beneficial to all parties involved, but if they won't honor my schedule that's a big deal breaker.
