This week my boss told us to come in at 830 but we couldn't start till 930 because of rain . Now she doesn't want to pay anyone for that time . Is that legal? Here is the message sent to us
“I understand there was some confusion about the start of the day on Wednesday that I would like to clear up.
I know you all understand the weather is unpredictable and forecasts are not clad in iron.
Because several crew members have long drives, the decision on cancelling or delaying is made hours before the workday starts. We try to be respectful of people’s personal time and try to balance the work opportunity with the commute. The fact that everyone’s income depends on the opportunity for hours also weighs heavily on the decision. It is not always a perfect call.
Rain delays happen in this business – although not so much this year with the drought! The policy is that you are not paid for rain delays, and you are expected to wait a reasonable amount of time for the rain to clear before being dismissed by the crew leader.
Yesterday, seeing there would be an hour delay, I had intended, as a good will gesture, to offer coffee and donuts to the crew while you waited for the rain to clear. I understand for several reasons, it did not turn out that way. I apologize for the miscommunication; it was not intended to be an obligation or required attendance on your part.
