My state is Ohio, and I work in the restaurant industry.
I work 10-11 hours shifts starting at 3pm-1/2am. I get sent on break around 5-5:30 pm. With consecutive 8-9 hours without an official break afterwards(i decide to escape/hide in the break room because fuck that). When I say no when I'm sent on break that early, they say “then no break at all.”
I know this is illegal, but I'm trying to find the proper way to stand my ground before I go into work today. I REFUSE to work 8-9 hours without break at an exceptionally busy restaurant. I mean busy busy. Full dine-in, full drive-through, full web orders the majority of the shift. My station is a flat-top grill, which can be very physically exhausting. We serve steak patties, which are smashed. I get shooting pains up my wrists.
I'm going in at 3 today. I know they're going to tell me to go on break at 5-5:30 pm. What can I say? What can I bring up legally?
