New HR person says I’m not allowed to get tips anymore

I’ve worked at the same place for two years on a sales floor selling goods all day to our customers. I do a variety of tasks but spend a bulk of my time interacting with customers and doing transactions. I’m a shift lead so I have to do cash drops and assign other workers to their positions. Recently, a different shift lead was to promoted to Assistant Manager of the store. They were still taking tips so another employee complained to our new HR person. When I was promoted to my position I was never told that I would be considered management or that if I took the job I could lose my tips. Tips I receive can range anywhere from $100 to $250 a week and I rely heavily on them.

So my question is, can they legally take my tips? Is there anything I can do?
