Possible loophole or straight up wage theft?

So SWIM is a Target employee from California who has worked over 8 hours in a day but less than 40 hours in a week so far, though 40 is fast approaching. The issue arises that after working in excess of 8 hours per day SWIM is not receiving 1.5 times base pay after 8 hours but instead is receiving $1 more. Is this legal? Of course this will be cross-posted to legal advice in all likelihood.
