I recently have been applying for a few bartending jobs, one specifically at a ski resort. I have many years of bartending experience including at ski resorts. Both my references were supervisors from my old resort and would have nothing but great things to say on my behalf.
Yesterday I had a phone interview for a bartending position at the resort. It want very well but at the end, the interviewer mentioned my nose ring and red hair. I remembered they had required a photo in the application, which I thought was weird at the time but didn’t question it. Today I received an email saying they couldn’t hire me due to my hair color and that they wouldn’t be offering me a position (to work as a bartender mind you.)
Is it legal to require a photo of the candidate in the application process? Is it legal to outright deny a candidate based off appearance?
